Smart resume not working on Fox NFL games.

Every week when I record an NFL game on Fox, it starts with a message telling me either smart resume enabled or highlights. No smart resume is available, and highlights are either not showing or I could see two or three highlights available. For an NFL game you know there would be more than one or two highlights. This seems more consistent with fox in NFL games. Why is this?

To be clear I'm more concerned with the smart resume not able to allow smart resume as there is none available to fast forward through. Highlights I could care less, but smart resume is a feature that should work. Again no it doesn't happen for everything. Consistently it happens with the channel on Fox and NFL games.
