sudden drop in download speeds

in the past few days I have encountered a sudden drop in download speed. My contract is "up to 800 MPS" but today it dropped to 39. How do we go about getting a rate rebate for the lack of contracted service?

I personally believe that this is tied to Xfinity's roll out of network only offering with Xfinity equipment tie in.
