Xfinity mobile trade-in offer issue

I availed xfinity mobile trade-in offer and traded my old S20 5g(which I purchased from xfinity earlier) for S23 galaxy.

Assurant sent the mobile device back saying the device IMEI number doesn't match.

I called xfinity and shared the details and they acknowledged that there is some issue with Assurant and they made a mistake and we will share a new return label and provide you credit. Now after multiple attempts and follow-ups I haven't received the credit and old device is still with me.. I got to know from xfinity that they are following up with Assurant and it will take longer. It's already been 3 months. This has been pathetic experience and I am thinking to sue them for the harassment.
