comcast agent told me i had an unlimited plan and would not be effected when the data caps were added. I can't help but notice that i now have a "xgb remaining of monthly plan" under billing. I better not be getting charged if i go over this cap.

Unlimited isn't truly unlimited. The only way to get true unlimited data is to sign up for Unlimited Data.
well than they have just opend themselves up to a load of problems because i saved a conversation from support that explicitly told me i would not ever be effected by this with my current plan and willbe contacting them

1) Pay them another $30 per month to remove the cap
OR
Sign up for Gigabit Pro, which I recall seeing on an Xfinity information page, (which I can't find at the moment) has no such cap.
Those unfortunately are your only two options right now.

FWIW, the "Gigabit Pro" speed tier is only available in limited areas.
