I was sent the wrong modem.

Hello. 
I signed up for the new 25$ a month internet promotion with a free XFi gateway for two years. I believe that I was sent the the wrong modem/router; the promotion promised the XB7/8 modem (including all over the promotional materials) instead I was sent the outdated XB3 model that looks like it sat in someone’s house for a year before being packaged as new. 
Can I say false advertising!?
