Netgear CM2050V upload speed issues

I have seen other threads on getting faster upload speeds with the Netgear CM2050V [0] but I seem to be having the same problem with uploads limited to 41Mbps with a newly installed modem.

I'll explain and maybe someone from Xfinity can help me?

From the modem login page it shows the most recent firmware:

Hardware Version 1.01
Cable Firmware Version V10.01.03

I already spent a few hours in a chat, and a tech was here yesterday to confirm it wasn't a cabling issue, but I still have slow upload speeds. I asked the tech if there was anything I needed to do and he mentioned since it was a customer-owned modem it was all on me. That doesn't seem to be the case as there is no way for the customer to upgrade the firmware, and there are no settings in the modem login page that I can see. The tech also claimed his test modem was able to do 350Mbps upload, although when he used speedtest.xfinity.com it only showed 41Mbps.

So I'm stuck - is there any solution? Is the speedtest being throttled somehow? I've tried others and they similar numbers. I figured I would be seeing at least 100Mbps upload.
