Netgear CM1150V - Slow speeds < 400mbps

Anyone have a resolution for not geeting anywhere near gig speeds with this modem?  A tech came out on Sunday and ran a new line from the street and changed out some splitteers and it got no better in fact he said I really didn't even need the new line.

Any ideas? i would really like to get what I am paying for!
