CODA56 Upload locked at 40MBps

Hello! I have an issue with my upload speed. It appears I'm locked at 40Mbps with this modem. This modem is on the recommended list (CODA56) I believe I have the same exact problem as

I had switched to an Xfinity gateway, specifically because of this issue. I used the Xfinity for a few weeks, then decided to give the CODA56 another go. It worked fine, I had 300Mbps upload and no issue. Until I returned the Xfinity gateway. Now I'm back at 40Mbps up.

A while ago, I had a tech come over and we looked at the line. Everything is clear. Since we could not figure out what could be wrong, we switched to an Xfinity gateway. This resolved the issue. Last week, I decided to give the modem another go. I had no problem at all, I was getting my full 2.1G down/300M up. Until I returned the gateway a few days ago. Now I'm back down to 40Mbps up.

It is not. It's a (fairly) short cable directly from outside directly to the modem, and the router is an enterprise grade router.
