Formal complaint: Service sold based on false information, fraudulent misrepresentation.

I am writing to file a formal complaint regarding my Xfinity phone plan. The service was sold to me based on false information, which I have identified as fraudulent misrepresentation.

This practice is a clear breach of my rights under California's consumer protection laws and also appears to violate federal FCC regulations. I have researched my rights and the recourse available to me as a consumer.

On April 11 we contacted Xfinity to start the process of porting our numbers to Google FI. The person on the chat asked us why we are leaving. We stated there was a free phone deal with Google FI to get the Pixel 9 for free. The Representative said I do not want you to leave. He said he will do his best to keep us if we re-sign. He stated he can get us the Google Pixel 9a for a low monthly cost of $3 a month if we re-sign. We agreed to stay and the full transcript was recorded via: Chat ID 908152596206957864

We noticed the bill was incorrect a month later and called Xfinity customer service on Call Date: May 16. The cost of the phone was not discounted, and we are paying $20 per phone (2 lines) each month which was not part of the agreement with the representative. I was told the issue will be resolved and a credit will be applied. 

We then noticed the following month that this was not corrected and called again. Call Date: July 7.

This has continued each month and I called again in August. I asked to speak to a supervisor and was promised this will be resolved. Refer to call date: August 6. Call ID: 10009048231754504372

Again in November this issue has continued. I called in November and was told there is nothing Xfinity can do and I need to post here to speak with Corporate Head office. Call details are: Nov 9. Call ID: 10004026701762718184. I had asked the Supervisor to file a formal complaint and was told the reference is ECM0017687192. The Supervisor stated they believe nothing will be done and I need to contact Xfinity via the chat forum…. I asked for a complaint email address and was told that does not exist. I was told to go to the forums and hope someone will pick this up?????

I have investigated my rights as a consumer in the State of California.  I have been informed that there is recourse in California for being sold a phone plan based on false information. I am going to raise a complaint with state or federal agencies and to pursue legal action. The agencies include the California Department of Consumer Affairs and the Federal Communications Commission (FCC). Xfinity has sold me a service under Fraudulent Misrepresentation and is in breach of the California Consumer Rights law. Additionally, the fraudulent misinterpretation is in breach of federal law under the Federal Communications Commission. I am in my right to contact the CDCA, FCC and the California Attorney General office. 

I ask that Xfinity contact me ASAP to resolve this.
