FedEx lost my phone

Hi I updated my phone last month and I still waiting for it I went to FedEx and didn’t find the package I went to Xfinity offices and they didn’t resolve nothing 

I made a claim to FedEx and they told me that is the shipper that has to make the claim I need help the new bill is coming with the phone fee 

it’s incredible that I have to pay for something that I don’t have

Did they ever resolve it?? I have been paying for a phone now for four months that they refuse to re-send or refund me for. I am considering filing a lawsuit.
