Tree resting on Xfinity aerial line—responsibility for removing tree
I live in unincorporated DuPage County, Illinois, near Wheaton. A tree from my neighbor’s property has fallen into my backyard and is now resting on and weighing down an above-ground Xfinity/Comcast communications line that runs across the rear of the properties.
I have contacted Xfinity and was told that Xfinity does not remove or cut trees that are resting on its communications lines. I was told that the property owner should have a tree contractor remove the tree, and that if the Xfinity line is damaged or comes down during the tree removal, Xfinity will then repair or replace the line.
The tree contractor is reluctant to proceed while the tree is resting on the Xfinity line because he is concerned about damaging the line and about potential liability.
Could an Official Xfinity Employee please confirm Xfinity’s policy in writing:
- Is it the property owner’s responsibility to hire a tree service to remove a fallen tree that is resting on an above-ground Xfinity communications line?
- Does Xfinity expect the tree contractor to proceed with removing the tree even though doing so may cause the Xfinity line to fall or be damaged?
- If the line is damaged or brought down as a consequence of efforts to remove the tree branches, will Xfinity repair or replace its line at no expense or liability to the home owner or the contractor?
- Is there any procedure I should follow before the contractor begins work—for example, notifying Xfinity so that a service call can be arranged if the line is damaged?
I am specifically looking for confirmation from an Official Xfinity Employee, because the tree contractor would like written confirmation of Xfinity’s position (and his lack of potential liability) before proceeding.
