easement

I am putting a fence on my property and have a utility easement that I need approval to encroach into. There is no interference with posts where the CATV line crosses. How do I get the approval letter?

Greetings, @user_gjwkai! Easement rights are a public utility right-of-way that helps Comcast maintain its equipment. In the areas where Comcast has overhead cable lines, the space for the lines is rented from the public utility. For areas where the cable lines are underground, the easement is usually three to five feet in from the sidewalk/roadway or maybe in a backyard. If you’re concerned about the location or the condition of a pole(s), please contact your public utility company. Any easement that may exist on any property is always noted on the title report for that property. The title report is provided to the property owner at the time of the purchase by the title company.

I'd also encourage visiting the "Call Before You Dig" website at www.call811.com for tools and information to help with any excavation needs. 811 is the designated "Call Before You Dig" phone number that directly connects you to the local One Call Center. Each state has different rules and regulations governing digging, some stricter than others. More info including State-Specific Information can be found here. I hope this info helps!

To obtain a build permit for a fence I am supposed to get a letter of approval from the utility company that has lines in my backyard utility easement. Comcast’s is the only utility line back there. 811 has come out and marked where the CATV line runs underground. There is no conflicting with where I plan to put fence post. How can I get a letter of approval that I can encroach into the easement that only contains Comcast wires.

Thank you for the detailed response, I got you, @user_gjwkai! If it's a pole that you're concerned about, please contact your public utility company. The local Public Utility Company (think power), and I'd suggest doing a quick search online with your zip which should give us a better idea of possible points of contact. A search such as - a public utility company near me, or public utility company + your zip.

Easement Rights Policy

If digging is an inevitability for the project, the call before you dig contact information will cover that aspect. Please let me know if this info is helpful and/or if it yields different points of contact, so you can get that fence knocked out before the lovely spring weather starts rolling in.

@user_gjwkai needs a letter of approval at this point.  Everything is already marked.  They need the letter in order to continue putting up the fence.

There are no poles to be concerned about and Comcast CATV is the only utility of concern.
