early termination fee

We are moving and want to bring our xfinity service with us but xfinity does not service our new house.   Xfinity is charging us an early termination fee because they can't deliver their service.  We will never again use xfinity for anything and will spread the word about how dishonest their policies are.

What is deceptive about it?  All of their plans come with an early termination fee.  That fact is not hidden from anyone.  I am not defending xfinity, neither do I work for them, but I just hate to see someone accusing a company of fraudulent activity when there is none.

They have an obligation to deliver service.  I want to bring it to my new house.  They can't deliver on their end.  So they break the contract then fix it with a clause saying they aren't responsible on their end because they failed to put up lines in a neighborhood.

No, Comcast doesn't have an obligation to deliver service in an area where they don't provide service, especially if another company does provide service.  You are the one effectively breaking the contract because you are moving out of a Comcast territory into a territory where Comcast services don't exist.  You agreed to this when you started your service with Comcast - it's in your contract.

If you are under a contract and you need to cancel service, you may be subject to an early termination fee (ETF).

 

    If you move to a Comcast serviceable area, and transfer service, you are not charged.
    If you move to a Comcast serviceable area, and do not sign up for service, then the ETF would apply.
    If you move to a non-Comcast serviceable area, then the ETF does apply.
    If it is an active duty military deployment, then the ETF will be waived when you send documentation.
    If the account holder is deceased, the ETF will be waived upon receiving a death certificate or obituary.
    If you downgrade service, then the ETF will not apply.
    If you have a Double/Triple Play and remove all but one service, then the ETF will not apply.

Once again, they never guaranteed that they have service at your new location. I am sorry for your frustration, but you are making false accusations here.  They did not break a contract with you, because the contract had ample notification of the early termination fee, and as I stated they do not guarantee service at a different location in your contract.  I am sorry that you are in this situation, but not a bit of it was deceptive or fraudulent on the part of xfinity.
