Wrongly Charged Install Fee?

Recently set up service at my new apartment and it's my first time using xfinity. I had a lot of issues with my internet my first weekend here and had to call support to look at it.

They had to bring out a tech (which I asked if this would happen if I would be hit with a charge they said no). After looking at the set up the original gateway I was given was bad and had to be replaced. So why am I being charged a professional install fee when it was their own equipment causing issues and I'm getting mixed responses from support.

Feeling really taken advantage right now since I've never experienced this issue with any other cable company I've used before.
