Fraudulent charge for unrequested and unused equipment
I signed up for internet service in February of last year, and informed the Xfinity employee who installed my internet that I had no interest in TV or streaming services from Xfinity. For the next few months, I was billed and paid only for the service I requested and was using. On my July 2024 bill, however, the following additional charge appeared: "Lmtd Basic Converter $9.85 / This Equipment is Inactive, to Avoid Future Charges
Please Return The Equipment to your Nearest Service Center". The same charge appeared on my August, September, October, November, and December bills. My January 2025 bill reflects a charge that is identical except that the amount billed was, incredibly, increased to $11.85 per month.
I did not request this equipment and my billing statements themselves show that the equipment was NEVER used. I have now returned the unused equipment that Xfinity forced on me, but the customer service representative stated that I could not receive a refund for the fraudulent charges because I had not reported them within 120 days of the first charge. So, essentially, Xfinity is telling customers that, by trusting Xfinity not to introduce fraudulent charges on their bills for unused equipment and not scrutinizing their bills every month for such charges, customers waive their right to a refund of those fraudulent charges.
This practice violates, among other things, Section 5 of the Federal Trade Commission Act, which prohibits unfair and deceptive practices by businesses - and seems like fertile ground for a class action lawsuit and/or a suit by the FTC or a state attorney general.
Please immediately refund the total amount you have fraudulently charged me: $59.10 ($9.85 x 6 months) + $11.85 (January charge) + $6.35 (February charge of $11.85 - prorated "credit" of $5.50) = $77.30.
