Modem & speed question

I was told by CC the dBmv @ 38 is fine, arris said it should be 45. Who is correct & why?

I am getting a fluxuation in DL speeds, was told to check this and see dBmV is 38

It depends on your local CMTS / system. It may indeed be "fine" for yours. What do the downstream power level and the SNR figures look like ?

Those are a tad high but are o/k. How much of a flux in speed are you getting ?

10 mbps (91-81)  with ether cable. 5 mbps (35-40) wireless on laptop

That amount bof speed fluctuation is nominal and to be expected on a shared bandwidth medium such as DOCSIS cable based internet. Now the difference between the wired and the wireless speeds is another story.

There are other options. Google for WiFi repeaters / range extenders, WiFi mesh systems.
