Trust me, I will continue to test my speed and post the results. However, I will probably back off on it during the next 14 days as I have no expectations of seeing any changes during that time that can be attributed to anything other than overall bandwidth usage by all those on my node.

In the state of Louisiana it is perfectly legal to record someone without their knowledge. The law only requires that ONE of the parties be aware that the conversation is being recorded.

Louisiana

Unless a criminal or tortious purpose exists, a person can record any conversations transmitted by wire, oral or electronic means to which he is a party, or when one participating party has consented. A violation of the law, whether by recording or disclosing the contents of a communication without proper consent, carries a fine of not more than $10,000 and jail time of not less than two and not more than 10 years at hard labor. La. Rev. Stat. § 15:1303.

The Court of Appeal of Louisiana for the Second Circuit held that a wife’s secretly-recorded telephone conversations with her husband on her own telephone were not illegally intercepted since the calls were recorded by a party to the conversation. Brown v. Brown, 877 So.2d 1228 (La. Ct. App. 2004).

"A violation of the law, whether by recording or disclosing the contents of a communication without proper consent,..."

Wouldnt posting the recording on this forum be disclosing the contents of said communication...without proper consent?

No as it is defined prior that only one party need know.

"a person can record any conversations transmitted by wire, oral or electronic means to which he is a party, or when one participating party has consented." (YOU can be that party)

After being burned by people lying about what was said in conversations affecting my life, I have found that wearing a recorder when I am dealing with people from Doctors and the Police to people in the Service industry saves me a ton of hassles and pain. If you are honest, you have nothing to worry about. How you would feel if it were you has nothing to do with this issue so please confine your posts to this issue as the legalities of my recordings have been discussed and cleared.

It seems likely that the node that you are connected to needs to be split. This may be the equipment order which they told you about.

At this point, why don't you just consider trying other providers in your area. Is DSL service available ? How about going to a satellite provider for your T.V. service ?

THIS rant has NOTHING to do with the people (technicians) and Manager (Rick) who HAVE gone above and beyond to resolve these issues. This goes to Management for droping the ball at almost every turn.

All through this I have had Comcast calling me trying to Up-Sale me on service when they can't provide the lower level they are supposed to be providing me now! Bad move! Not real smart.

Someone/some system screws up in billing, first over a PENNY resulting in a minor but annoying late fee at a time when I am fighting for adiquate service. TWICE. Bad timing. SOMEHOW, they "fix" that issue by losing the payment I made for the right amount and on time resulting in the issuing of a nastygram wanting to get paid what they have already been paid. Bad timing.

You add it all up and it makes a person rather angry. Especially when that person is a disabled vetern who lives in constant pain and who's only real source of relaxation and entertainment is to surf the Internet and watch his TV as he is bound to his recliner most all day, most every day.

"How about the fellow customers who have tried to help you... "

They aren't a part of this but at least now they know that there are other issues that they should watch out for themselves.

"I very well know your situation from earlier on in your thread... Yer' preachin' to the choir here good sir..."

I know that and thank you, as I have from the start. This isn't directed at you but as a "head's up" for others.

"Speak with your wallet and seek some other providers."

:-D I am a guy who has lots of these days and I have never run from a fight in my life and a fight is what Comcast has started here. From here on though I will limit myself to Technical issues only which, as I said, I know they are working on and they have several more days before I am to expect any improvement in my signal.

I think you have every right to rant. There is not one single thing wrong with any of the dollars you have been paying Comcast. In return, Comcast owes you the service you have been paying for, or at least their very best effort to provide that service. You have received neither.

It seems that Comcast either doesn't know how to fix your problem or doesn't want to (too much trouble, too much expense). At this point they are possibly hoping that you will either give up or just cancel your service so they don't have to deal with you any longer. Nothing personal, you understand, just business.

I think you've given Comcast more than sufficient opportunity to fix their problem(s). You really ought to consider a louder microphone. You didn't make a mediocre effort for Uncle Sam. The very least your country owes you is decent cable service.

Thanks sir. Once I am properly awake, I will begin what usually turns into an hour wait to reach a Manager at Comcast and try to get my bill straightened out for the third time now.

As to the signal issue, like I said, I firmly believe that IS being addressed. Late to be sure but I fully expect it to be resolved to my satisfaction before it is all over thanks to people on this forum and a supervisor named Rick who got involved late in the game.

I am here today to fall on my sword and eat a huge helping of crow. The billing error was MINE, NOT Comcast's. It was very confusing and the phone calls I had made regarding it previously were obviously misunderstood on both sides as I was told I was up to date when I wasn't twice before and then I am one penny different than my payment behind the next month which really screwed me up.

Comcast, I was wrong and am sorry for the ranting. I tried to make sense of the issue this morning with the first contact in billing and couldn't but once we got a manager involved and worked our way through it I understood what happened and I will have my bill caught up by the due date.

Again, I apologize for the misunderstanding on my part regarding my bill.

OK, I am now ahead on my bill. Again, I am sorry for going off on Comcast on the bill. I wish it would have been resolved 2 calls ago but here we are. We have another week before the parts are in and we can see if the issues are resolved. Since the last change, performance IS better but still sub-par but that is not unexpected and I understand.

PS: I did verify that I have had the Performance package that is advertised to have high speed but in fact is only 6 to 8 down depending on who you talk to.

Knowing I'd believe

Promises, promises

You knew you'd never keep"

What part of shreveport you live in? I live in southern hills and having the similar problem..one night I get 15megs d/l, then the next I get 2megs d/l. On the 17th will be their 3rd and final trip out to my house. If not fixed, I'm switching back to dsl.

Hopefully at&t u-verse will be here shortly...i agree with a few of the other posters, speak with your wallet...switch to dsl.. If the problem could have been corrected, comcast would have done it by now..

Wow, this thread shows how bad Comcast can suck sometimes.  I'm sure there are talented technicians that work for Comcast.  I just wish they had more than a few across the country.

Have the technicians replaced your cable modem?  Did you or Comcast check all the splitters and/or replace them?  Splitters can go bad.

Also did they replace any coax cable leads going to your modem?  If its in-wall did they use a cable tester on your lines?  Did they check the signals at the tap/dmarc location?  Did they re-thread your incoming line?

Did they move your line to a different port on the pole?  Your getting some bad noise from somewhere.

Your upstream signal tells some of the story that your modem is litterally screaming to talk back to Comcast and maybe they/Comcast has a bad piece of equipment they need to replace.

"Have the technicians replaced your cable modem?"

No

"Did you or Comcast check all the splitters and/or replace them? Splitters can go bad."

Yes, several times!

"Also did they replace any coax cable leads going to your modem? If its in-wall did they use a cable tester on your lines? Did they check the signals at the tap/dmarc location? Did they re-thread your incoming line?"

Yes to all. All the cables weren't replaced but a few were, ALL were tested by the techs.

"Did they move your line to a different port on the pole? Your getting some bad noise from somewhere."

Couldn't  say but they have been up my pole several times and did "something" each time.

"Your upstream signal tells some of the story that your modem is literally screaming to talk back to Comcast and maybe they/Comcast has a bad piece of equipment they need to replace."

They have been here 10+ times now and have had ample opportunity do do whatever needed to be done. They say all in the house and from the house to the pols is good. They HAVE found issues back to the "station" and ordered parts for this that should have been in a week ago but I have not been contacted yet or seen any improvements in my service.

It shouldn't take 7+ service calls for a Comcast manager including whomever is responding to this thread to credit you or even partial credit you for the weeks/months of poor service from the time you logged an issue. Have you actually asked to speak with a manager about your issues?  At this stage you should be receiving a full credit or at least a 90% credit for each service impacted.

Comcast, I realize that this guy represents one of many but Comcast should realize that they don't service the many without issues on a daily basis, they service the one of many with issues.

If I were you I would identify your Comcast corporate office and make a call.  Depending on your local city, Comcast may have a City representative you may be able to identify.

I don't want to be a pain the buttocks so I promise this will be the last time I say this:

Why are you still putting up with this? Go public! If you do it right, people will be on your side and you will get Comcast's attention. Go to the consumer advocate at your local newspaper or TV station...go to The Consumerist website...go to the FCC, etc. How much longer are you willing to be jerked around?

Okay, I've said my piece. Nevermore.
